Guard Europe B.V. ("Guard Europe", “we”, “us”, “our”) is the data controller for the processing described in this Privacy Policy.

2. Scope

This Privacy Policy applies to our webshop and website, to communication channels linked to them (e.g., contact forms and e‑mail), and to offline order and service activities insofar as they are tied to webshop processes.

3. Personal data we process

Depending on your interaction with our services, we may process:

• Identification & contact data: name, company name, role, addresses, e‑mail, phone.

• Account data: login (hashed password), user ID, preferences, language, role permissions.

• Order & payment data: products/services ordered, order history, billing/shipping details, payment status/method (card payments are handled by our payment provider; we do not store full card numbers or CVC codes).

• Customer service & communications: e‑mails/messages, notes, complaints handling, warranty/RMA communications.

• Technical & usage data: IP address, device/browser data, session IDs, timestamps, logs, cookie IDs, page views and interactions.

• Marketing & preference data: newsletter subscriptions, preferences, consents and opt‑outs.

4. Purposes and legal bases

We process personal data for specific, explicit and legitimate purposes under the GDPR on the following bases:

• Performance of a contract: order intake and processing, delivery, invoicing, warranty/RMA, customer service.

• Legal obligation: tax and accounting retention, product safety/recalls.

• Legitimate interests: (B2B) direct marketing to existing customers, improving our website and services, fraud prevention and IT security (balanced against your interests and rights).

• Consent: e‑mail marketing where required and non‑essential cookies/trackers. You may withdraw consent at any time.

5. Cookies & similar technologies

6. Retention

We retain personal data no longer than necessary for the purposes for which they are processed or as required by law. Indicatively:

• Order/invoice data: at least 7 years (tax retention).

• Customer service communications: up to 2 years after resolution, unless longer needed (e.g., warranty).

• Accounts: while active and up to 24 months after last activity, or earlier on request.

• Marketing data: until you unsubscribe or withdraw consent.

• Logs/security data: typically 12 months, unless longer is necessary (e.g., incident analysis).

7. Sharing personal data

We do not sell personal data. We may share data:

• With processors (service providers): hosting, IT maintenance, payment provider(s), ERP/WMS, logistics carriers, customer service tools, e‑mail/newsletter platforms, web/data analytics – all under data processing agreements.

• With recipients where necessary: delivery carriers (shipping labels), accountants/advisors (legal tasks), insurers/claims handlers (RMA/damages), authorities where legally required.

• International transfers outside the EEA: only where permitted under the GDPR, e.g., adequacy decisions or EU Standard Contractual Clauses (SCCs) with supplementary safeguards.

8. Security

We implement appropriate technical and organisational measures to protect personal data, including TLS encryption, strict access controls (need‑to‑know), logging/monitoring and periodic reviews. No method is 100% secure; we continuously improve our measures.

9. Your rights

Subject to legal conditions, you have the right to:
access, rectify, erase, restrict, port your data, and object to processing based on legitimate interests and at any time to direct marketing; and to withdraw consent without affecting the lawfulness of processing before withdrawal.

10. Marketing (B2B)

Based on our legitimate interests, we may contact business representatives of (prospective) customers with relevant information about our products and services. You can unsubscribe at any time via the link in the e‑mail or by contacting info@tkguard.eu.

11. Minors

Our webshop targets professional/business customers and is not intended for individuals under 16. We do not knowingly collect data from minors.

12. Automated decision‑making

We do not make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you.

13. Changes

We may update this Privacy Policy from time to time, for example, due to legal changes or updates to our processes. The latest version will always be available on our website, clearly marked with the date of the last update.
